Policy Groups Update

Here’s a look inside what was discussed in policy group meetings this week:

Member Policy Call: On June 3, SHLB’s biweekly member policy call opened with a Spotlight presentation from Annie Norman, Delaware’s state librarian.

Annie worked closely with the Delaware Broadband Office to receive a grant through the new Digital Equity Act Capacity grant program and has nearly $2 million in federal funds earmarked for its school library project.

ACP news was also relayed:

  • Congress did not renew funding for the ACP. The White House obtained commitments from a dozen of the largest ISPs to continue their affordable broadband rate of $30/month or less. The Senate Commerce Committee continues to pursue legislation to restore the FCC’s spectrum auction funding and use some of the funding for ACP.

Anchors for Digital Equity Call:

  • 22 state broadband plans called for investments in community wireless networks.

  • NTIA approved every state’s Volume 1, but only 7 states have received approval for Volume II. Some states are not pushing for faster NTIA approval, as they need the extra time to make their grant awards.

  • Every state submitted a request for funding from the Digital Equity Capacity Grant program.

E-Rate Policy Call: On June 6, we discussed a host of issues:

  • The FCC voted (3 approve, 2 dissent) to approve the Schools and Libraries Cybersecurity Pilot Program, so members will be on the lookout for the final Report and Order in the coming weeks.

  • SHLB suggested that the FCC establish a new “Category 3” budget to fund its proposed hotspot initiative under E-Rate.

  • Members expressed their questions and concerns about a government funding bill that was passed in March 2024 rescinding $1.768 billion in “unobligated” funds from the ECF program.

SHLB Filings and Letters

Cybersecurity Ex parte letter: On May 29, SHLB, ALA, CoSN, and Common Sense filed an Ex parte letter to the FCC outlining several questions, concerns, and issues related to the implementation of the FCC’s Schools and Libraries Cybersecurity Pilot Program draft Report & Order.

We sought clarification on whether pilot applicants’ budgets reflect annual amounts (rather than an overall amount throughout the duration of the pilot), eligibility for cost-allocated components from E-Rate applications, and the expected start date of the Pilot.

Issues We’re Working On

Rescission of Congressional Funding and its impact on ECF: The March 2024 government funding bill withdrew $1.7 billion from the unused ECF program funds. This cut limits the FCC’s capacity to adjust current funding or commit new funds, even for appeals. SHLB members worry about the potential negative effects on schools and libraries and intend to address this with the FCC and Congress.

Eyes on the Board Act: SHLB continues to work to oppose Sen. Cruz’s “Eyes on the Board Act”, which could be scheduled for a Senate Commerce Committee vote soon.

School Bus Wifi Court Case: SHLB plans to file an intervenors’ brief to defend the FCC’s School Bus Wifi decision next Monday, June 10.
